Terms of Service

1. Acceptance of Terms

By creating an account, downloading, or using the 'Kium' mobile application and its associated services, you declare that you are a natural person with legal capacity to contract and express your binding and unconditional acceptance of these Terms of Service. If you do not agree with any of the clauses stipulated herein, you must immediately refrain from using the software.

2. Service Description and Subscriptions (Google Play Billing)

Kium operates under a Freemium business model, offering a free tier subject to management limits and advanced features through monthly or annual subscription plans (PRO Plan).

• Payment Processing: All transactions, purchases, and renewals for the PRO Plan are processed exclusively and securely through Google's official Google Play Billing gateway.
• Automatic Renewal: Subscriptions renew automatically at the end of the contracted period, unless the user cancels the subscription directly in their Google Play account settings before the billing date.
• Refund Policy: Refunds are managed and governed by the official Google Play Store refund criteria and policies. Valtarius does not process direct payments or manual reversals.
• Fee Modification: We reserve the right to adjust subscription prices. Any changes will be notified with reasonable advance notice through the application's official channels.

3. Intellectual Property and Usage License

Valtarius grants the user a limited, non-exclusive, revocable, and non-transferable license to use the Kium application for strictly commercial and internal business management purposes.

• Software Rights: The source code, interface design, database, trademarks, logos, backend architecture (NestJS/GraphQL), and software copyrights are the exclusive property of Valtarius.
• User Data Ownership: The user retains absolute ownership and rights over the information entered into the system (product catalog, sales records, and prices). Kium only processes this information for operational and cloud synchronization purposes.

4. Terms of Use and Liability

As a Kium user, you commit to legitimate and secure use of the management system, assuming the following responsibilities:

• Information Accuracy: You are solely responsible for the accuracy, legality, and truthfulness of the inventory and sales data uploaded to the application.
• Account Security: You must safeguard your access credentials. Any activity performed under your account shall be considered performed by you.
• Prohibited Use: It is strictly prohibited to attempt to breach backend security, perform reverse engineering, use unauthorized automated scripts, or saturate APIs through abusive use.
• Tax/Accounting Exclusion: Kium is an automated technological tool for operational and statistical support. It does not constitute accounting, legal, or tax advisory service, and the user remains responsible for compliance with their local tax regulations.

5. Limitation of Liability and Warranties

The software is provided 'as is' and 'as available'. Although Kium is structured under an 'offline-first' design architecture using Room to ensure local data persistence and mitigate losses during network failures, Valtarius does not guarantee that the cloud service will be uninterrupted or 100% error-free.

• We shall not be liable for commercial damages, loss of profit, or errors in sales records derived from unforeseen cloud server interruptions, user negligence in safeguarding their mobile device, or accidental record deletion by the operator.

6. Modifications, Suspension, and Termination

Valtarius reserves the right to discontinue, modify, or temporarily or permanently suspend access to the service in case of detected violations of these terms, fraudulent conduct, or activities that jeopardize the integrity of the digital infrastructure.

• Users may terminate these terms at any time by uninstalling the application and canceling their subscriptions through the Google Play Store.
